OVERVIEW STATEMENT:

The City has allowed the closure of public Right of Way (ROW) for the benefit of private businesses without charging a use fee nor the excise tax on the value of the use fee that has been paid to the State. Private use of ROW limits public access and enjoyment of sidewalks, landscape, bike lanes, parking, and travel lanes. To balance the needs of private businesses with the needs of the public, Public Works is proposing a use fee and the State-required excise tax beginning January 2025 for extended closures of the public right of way.
Proposed use fees are for construction activities.
• Construction Activities: Monthly fee of $0.75 per square foot of closed ROW
This will require adoption of a Fee Resolution.

Sidewalks, bike lanes, multiuse paths, and trails shall be provided in public rights-of-way or easements across private property that guarantee public access.

OUTCOMES:
The Extended Use of Right of Way Fee proposal creates an incentive for businesses to minimize private use of the public Right of Way to what is necessary so that sidewalks, landscape, bike lanes, parking, and travel lanes can be used as intended.
