The second Amendment to the Transit Way Agreement adds the right of way adjacent to the Overlake Village light rail station and DaVinci Avenue. The Transit Way Agreement enables Sound Transit to complete construction as well as operate and maintain station elements in right of way.

Detailed review of the Overlake Village light rail station site determined an amendment to the Transit Way Agreement is necessary to allow Sound Transit to implement, operate, and maintain infrastructure, such as security cameras and signs, that overlaps the property boundary between the Overlake Village Station and the DaVinci Avenue right of way.
OUTCOMES:
Council approval of the second amendment to the Transit Way Agreement allows Sound Transit to open and operate the portion of the Overlake Village light rail station elements adjacent to, and within, the DaVinci Avenue right of way.

Staff from each public works functional area and transportation maintenance and engineering were involved in reviewing the Overlake Village Station Operations and Maintenance Agreement. The Transit Way Agreement enables components of the Operations and Maintenance Agreement to be implemented and therefore relied on the Overlake Village Station Operations and Maintenance Agreement process for staff outreach.
• Feedback Summary:
City staff would prefer not to utilize the Sound Transit track access process which adds Sound Transit permitting requirements for City maintenance of City assets on Sound Transit property. However, staff recognize the requirements are placed on Sound Transit by federal railroad rules and that the City assets, such as the Overlake Village Pedestrian Bicycle Bridge, are important and worth maintaining even with the additional requirements.
