III.                     DESCRIPTION/BACKGROUND

 

On June 19, 2018 City Council approved Ordinance No. 2925 amending the RMC 12.14 to establish the processes for permitting and the construction standards for Wireless Communication Facilities and Small Cell Networks.

 

On September 26, 2018 the Federal Communications Commission (FCC) adopted the Declaratory Ruling and Third Report and Order and Final Rules for “Streamlining State and Local Reviews of Wireless Facility Siting Applications”.  The Final Rules establish new federal standards for review times, aesthetic standards, administrative fees, and rent for the use of City poles for installation of Small Cell Facilities. 

 

Planning and Public Works staff have been working with the City Attorney’s Office and telecommunications service providers to revise the Redmond Municipal Code (RMC) and the Redmond Zoning Code (RZC) to conform to the Final Rules.  These efforts support both state and federal mandates to promote the efficient deployment of Small Cell Facilities and Networks, and to offer a predictable process for wireless service providers.

V.                     IMPACT

 

A.                     Service/Delivery:

 

Approving these amendments will establish regulations and process for future deployment of Small Cell Facilities to provide increased wireless coverage and capacity to support emerging 5th generation (5G) wireless telecommunications and the Internet of Things (IOT)

 

B.                     Fiscal Note:

 

The established user fees and rent collected for leasing of City poles for small cell facilities should offset any costs to the City for staff time spent in reviewing, permitting and processing of agreements for these installations.

 

VI.                     ALTERNATIVES TO STAFF RECOMMENDATION

 

If the Council does not adopt this Ordinance, the City will not be in compliance with FCC Title 47 Code of Federal Regulations (CFR) Part 1.6

 

VII.                     TIME CONSTRAINTS

 

The FCC ruling set January 14, 2019, as the effective date of their Report and Order and Declaratory Ruling.

 

Adoption of this Ordinance will bring City code into compliance with FCC regulations.
