III.                     DESCRIPTION/BACKGROUND

Smith Woods is a City park property located in northeast Redmond (see Attachment 1). The property includes a small stream that is a headwater to Monticello Creek. The stream flows into a small pond on the property which appears to have been built by the former owner before the City secured the land in 2000 and 2011.  Due to concerns regarding the stability of the berm surrounding the pond, the City completed an emergency project in December 2015, cutting a temporary channel to reduce pond volume to eliminate the immediate risk of berm failure.  This work was done under an emergency Hydraulic Permit Approval (HPA) from the Washington Department of Fish and Wildlife.  As a condition of this HPA, the City is required to rehabilitate this pond and stream to create a fish-passable channel by 2021.

In March 2019, the City contracted with Osborn Consulting to assist staff in developing alternatives for the stream and pond that will improve fish passage, while also serving as an amenity for the future City park on the Smith Woods property. The consultant collected data on the project site and produced information necessary to develop these alternatives, including wetland, hydrology, geotechnical and cultural resource reports.  In November 2019, staff presented the alternatives to the department directors and the Council Planning and Public Works Committee and received approval to proceed with an alternative that retains the existing pond.  Since that time, the consultant and staff have worked together to further develop the engineering plans and supporting documentation.  These documents were used to submit permit applications in June 2020 to the City of Redmond, the Army Corps of Engineers, the Washington Department of Fish and Wildlife and the Washington Department of Ecology.  Permit documents were also provided to the Muckleshoot Tribe for their review and comment.

Staff expects that the process to receive all permits will take 6 to 9 months. During that time, additional consultant assistance will be needed to respond to permitting issues and to develop the final engineering plans for project advertisement. This requires the execution of Supplement Agreement #1 (see Attachment 2).

V.                     IMPACT

A.                     Service/Delivery:

This supplemental agreement will allow staff and the consultant to respond to permitting issues and to develop the final engineering plans for this project.

B.                     Fiscal Note:

This project is a cooperative effort between Public Works and Parks.  Funding has been budgeted from both Parks and the Stormwater CIP for the development of the alternatives, final design, permitting and construction. The original consultant agreement had a contract amount of $180,000 for alternatives analysis, preliminary design services and permit preparation.  Estimated costs for this project are shown below:

Current Project Budget:

Stormwater CIP                                                                                                                              $735,000

Parks CIP                                                                                                                                                   $378,000

Total Funding                                                                                                                                                   $1,113,000

Estimated Project Cost

Design Phase                                                                                                                                                   $525,000

Construction Phase                                                                                                                              $588,000

Total Estimated Project Cost                                                                                                         $1,113,000

VI.                     ALTERNATIVES TO STAFF RECOMMENDATION

Council could choose not to approve this Supplemental Agreement and direct staff to continue negotiations with the consultant to revise the scope and fee of the Agreement.  This would delay action on design and permitting for this project.

VII.                     TIME CONSTRAINTS

As a condition of this HPA, the City is required to rehabilitate the pond and stream to create a fish-passable channel by 2021.  At this time, the permit process is expected to extend into early 2021, followed by preparation of final design documents and advertisement for bid in spring 2021.  If this process is delayed, the project may not be ready to construct in 2021.
