Approve a consultant agreement with Osborn Consulting Inc. for alternatives analysis, preliminary design services and permitting for the Smith Woods Pond / Stream Rehabilitation, Project No. 20021811, in an amount not to exceed $180,000, and authorize the Mayor to sign the Agreement. Authorize staff to secure property rights necessary (if any) to construct and maintain the project.

III. DESCRIPTION/BACKGROUND
Smith Wood Park includes a Class 2/3 stream (headwater to Monticello Creek) which flows into a small pond that was built by the former owner before the City secured the parcels in 2000 and 2011. Site reconnaissance completed in 2015 as part of the Monticello Watershed Restoration Plan identified sinkholes in the berm forming the pond. At the recommendation of geotechnical engineers at Golder, the City completed an emergency project in December 2015, cutting a temporary channel to reduce pond volume to eliminate the immediate risk of berm failure. As a follow-up to that emergency repair, streambed cobble was later placed to stabilize the temporary channel. The Washington Department of Fish and Wildlife (WDFW) permit, for the emergency repair, requires building a fish-passable channel by 2021.
The project will be a cooperative effort between the Parks Department and the Environment and Utilities Services Division of Public Works. Funding has been budgeted from both Parks and the Stormwater CIP for design and construction. The purpose of this preliminary design work is to confirm the technical feasibility of the project, establish cost parameters and secure permits before committing additional time and money to finalize the construction details. Improvements are assumed to focus on the stream/pond components along with associated mitigation and restoration elements. Staff hopes to retain the pond if reasonably feasible and cost effective. One of the early steps in the pre-design process will be meeting with permit agency staff to understand how design alternatives could affect permit approvals. At the City’s discretion, it is anticipated that supplemental agreements will be negotiated for the selected consultant team to take the project through final design, bidding, construction and record drawing production.

Parks and Trails Commission has also had several updated on the project (January 2017, January 2018, November 2018) from Tom Hardy.
V. IMPACT
A. Service/Delivery:
A list of five firms was selected from the Public Purchase portal based on their Statements of Qualifications. The City received proposals from:
Osborn Consulting Bellevue, WA
Otak, Redmond, WA
Parametrix Seattle, WA
The City’s selection team evaluated proposals and determined that Osborn Consulting was the most qualified team to provide engineering design services. Negotiations will finalize the scope of work and determine a fair cost for the proposed work before the Council Business Meeting. Under this agreement Osborn Consulting will complete alternatives analysis, preliminary design and permitting for the project. The Consultant Agreement is the standard City Agreement, and will be reviewed by the City Attorney and Risk Manager prior signature by the Mayor.

VI. ALTERNATIVES TO STAFF RECOMMENDATION
The City Council could choose not to approve the consultant agreement for the preliminary design; however, this would delay project completion.
VII. TIME CONSTRAINTS
This project has been in both Stormwater and Parks 6-year CIP since 2017, and has been approved in the 2019/20 Budget.
The Washington State Department of Fish and Wildlife (WDFW) Hydraulic Project Approval (HPA) permit requires the project be completed by 2021. This is consistent with the 2019-2024 CIP.
