OVERVIEW STATEMENT:

Due to the State Building Code Council’s (SBCC) vote on January 8, 2021 to delay the implementation date of the State Building and Fire Codes from February 1, 2021 to July 1, 2021, we are requesting a change in the implementation dates of the above ordinances to coordinate with the State Codes. These ordinances were previously approved by City Council on September 15, 2020.

This adoption will allow the flexibility to coordinate the adoption of our local building and fire codes with the effective date of the State’s adoption. The request is not date specific due to the possibility of additional delays being recommended to the State from the State Building Code Council.

Time Constraints:

The Washington State Building Code Council adopted the 2018 Building, Fire, and 2020 National Electrical Codes to become effective on July 1, 2020. Governor Inslee’s Proclamation 20-40 “Stay Home Stay Safe” postponed the adoption until November 1, 2020. Although the National Electrical Code went into effect on October 30, 2020, the State Building Code Council (SBCC) postponed the adoption of all other codes until February 1, 2021.

 

On January 8, 2021, the State Building Code Council voted to again delay the implementation of the 2018 International Codes until July 1, 2021. Petitions have been filed by both the Washington State Building Officials and the Washington Association of Fire Marshals to enforce the February 1, 2021 effective date. A formal determination by the Governor on both petitions is expected before January 26, 2021.

 

 

ANTICIPATED RESULT IF NOT APPROVED:

The City of Redmond would be in violation of RCW 19.27.035 by adopting the 2018 International Codes ahead of the State, effective on February 1, 2021, as allowed for in the current language of ordinance numbers 3007 and 3008, if the State upholds the vote by the SBCC and the state adoption of the codes becomes effective on July 1, 2021.
